President Donald Trump’s administration has once again tightened its immigration policy with a new order now aimed at immigration lawyers.

The Department of Homeland Security, or DHS, instructed Immigration and Customs Enforcement, known as ICE, to strengthen actions against legal representatives accused of filing asylum applications considered fraudulent or lacking a legal basis.

The measure, revealed Tuesday through a memorandum cited by CBS News, adds to the mass deportation strategy promoted by the White House and marks a new front in the federal immigration offensive.

The document was signed by DHS General Counsel James Percival, who ordered ICE to implement stricter mechanisms to detect and combat alleged abuses within the asylum system.

According to the memorandum cited by CBS News, Percival instructed the immigration agency to develop “anti-fraud policies” focused on preventing immigration lawyers from filing asylum cases without legitimate grounds.

The directive argues that, in many cases, asylum applications have been used as a recurring strategy to stop deportations or delay immigration proceedings.

The text states that asylum applications have become a “common practice” used by lawyers who argue that “virtually every undocumented immigrant” faces persecution or torture in their country of origin because of protected characteristics, such as race, religion, or political opinion.

ICE Could Make Stronger Use of Existing Administrative Tools

Although the memorandum does not establish new criminal or civil penalties against immigration lawyers, it makes clear that ICE will have more room to act administratively against those it considers responsible for filing fraudulent applications.

The document says the agency’s efforts “should include measures against immigration lawyers who file false asylum applications before immigration courts.”

The order also anticipates more aggressive use of administrative tools already available within the U.S. immigration system.

This could translate into more frequent investigations, case file reviews, and possible disciplinary actions against legal representatives flagged by authorities.

So far, DHS has not detailed exactly how it will define when an asylum application will be considered fraudulent or what specific criteria will be used to evaluate lawyers’ conduct.

Trump’s Immigration Offensive Adds Pressure to Legal Processes

The new directive comes amid a series of measures adopted by the Trump administration to restrict immigration and speed up deportations.

Last week, the government announced another immigration policy that will require certain immigrants to leave the United States to apply for permanent residency, known as a green card.

That decision also represents a major challenge for immigration lawyers, who have historically accompanied their clients through processes carried out inside the country.

Now, with the new DHS instruction, legal representatives could face a much more hostile environment within immigration courts and asylum proceedings.

Various immigrant advocacy organizations have previously warned that similar measures could create fear among lawyers and affect migrants’ access to proper legal representation, especially in complex cases where proving persecution or risk in the country of origin requires lengthy processes and evidence that is difficult to obtain.

The asylum system in the United States has been under pressure for years due to the increase in applications and the backlog of pending cases in immigration courts.

With this new order, the Trump administration is once again placing the focus on the use of asylum as a tool for immigration protection and on the role lawyers play in these proceedings.

The memorandum makes clear that the government considers it a priority to stop what it describes as abuse of the immigration system, while continuing to reinforce measures to limit new immigrant entries and accelerate removals inside the country.
